NYC Eric Garner’s Case – Question of Law

This is a challenge for law students and paralegal students in New York City. It deals with our laws and raises legal questions concerning this case. Our future depends on your ability to truly understand the law of the land, that we can make it work for all people.


I was reading up on the s Local Law 97, “Sensible Tobacco Enforcement.”  And it doesn’t even deal with street pedalers.  The law was passed around March and May of 2014.

Retail Dealer Definition


What is the new law?


This law changes the definition of“retail dealer.” The new definition of retail dealer is any person who possesses or transports more than 400 cigarettes. A retail dealer is subject to various requirements, including having a valid New York City cigarette retail dealer license and a valid New York State Certificate of Registration to sell cigarettes or tobacco and paying required taxes on cigarettes in his or her possession.


Did Eric Garner fall under this criteria?


Then they arrested him and said he resisted arrest. I saw him raise his hands up, though he complained and all that was required was to take his hands and place them behind his back.  


The Arrest:


Why was he being arrested. First show me the charges, they are probably false. I do not see selling loose cigarettes by a  person who has less than 400 cigarettes or one carton as breaking any laws. This law is designed to collect taxes.


Now as for the argument he was killed over high taxes in New York City on tobacco.  That is an evil and insensitive statement.  Rand Paul isn’t trying to really run for President.  Lets us look at the stats a year or two from now and determine if we killed more people, due to the enforcement of laws that do not exist or from making cigarettes unattractive to our next generation, who will choose between weed or tobacco.


He said the war on drugs got too serious because we taxed the real schedule one drug and decriminalized the drug that is unconstitutionally being enforced as illegal when it is not.


During my rien Mr. Raul tobacco will be illegal. I am not creating a humankind with a 150 year life expectancy to destroy my temple.   I will lock up cigarette dealers and free the pot dealers. Because the war on drugs has gone too far.


What was the charge?


  • Selling loose cigarettes does it apply to him?
  • Crime punishable with a fine, did they ever request his ID to fine him?
  • Was all police guilty of excessive force if a minor crime was committed?
  • Did he resist arrest and based on what? His hands was up!
  • What would be the best recourse for his family? Lawsuit? Federal Civil Rights?  Both?
  • What should the the punishment requested?
  • What can fix the problem?


This should be a class project in colleges like the New York City College of Technology and the many law schools in our area. I think if we use our young great minds while in college before they get their 6 figure plus salaries, we can get cheap legal assistance by those who will be affected by the decisions they make and not these old as Nazi sympathizers.


I think tuition assistance is appropriate for their help. Make it a competition and pay a certain amount for the best 25 reports.  This kids should be making the decisions and not a bunch of incompetent people who just repeat what they are told and do not even read their job descriptions.  And is just looking for a quick buck doing business with foreign governments, giving up our Healthcare System to nazi Germans, while we incarcerate own own people for false drug charges, just to hand our nation over to Germany, Britain and France.
